Privacy Notice

This Privacy Notice explains how Klem Technologies LLC, a company registered in Scotland, United Kingdom ("Klem", "we", "us"), collects and uses personal data when you use the Klem platform (the "Service"). We act as the data controller for the personal data described below.

1. Personal Data We Collect

  • Account data — name, email, login credentials, plan and role.
  • Content data — projects, prompts, generated code and content, database records, uploaded files ("Your Content").
  • Support data — messages you send us and their attachments.
  • Usage & telemetry — feature usage, actions in the app, error diagnostics.
  • Device & log data — IP address, browser, operating system, device identifiers, timestamps.
  • Cookies — see Section 8.

Payment card details are collected and processed by our Merchant of Record, Paddle, and are not stored by us.

2. How We Use It

  • Provide the Service — create your account, run AI generation, store your projects, deliver support (legal basis: contract performance).
  • Security & fraud prevention — detect abuse, protect the platform (legal basis: legitimate interests).
  • Product improvement — aggregate analytics, quality of AI outputs (legal basis: legitimate interests).
  • Customer support — respond to your requests (legal basis: contract / legitimate interests).
  • Marketing — product updates and offers where you have opted in (legal basis: consent; you can opt out any time).
  • Legal compliance — tax, accounting, responding to lawful requests (legal basis: legal obligation).

3. AI Processing

Prompts you submit and content you generate are processed by AI models (our own and those of our AI subprocessors) solely to provide the Service to you. We do not use Your Content to train third-party foundation models without your consent.

4. Sharing & Recipients

  • Service providers / subprocessors — hosting, database, AI model providers, analytics, support tooling, transactional email.
  • Merchant of Record — Paddle.com Market Ltd, which handles the sale of our products, subscription management, payments, tax compliance, invoicing and refunds. Paddle acts as an independent controller for payment data.
  • Professional advisers — legal, accounting, auditors, where necessary.
  • Authorities — where required by law, court order, or to protect our rights.

We do not sell your personal data.

5. International Transfers

We are based in Scotland, United Kingdom. Some of our providers process data outside the UK / EEA. Where such transfers occur, we rely on appropriate safeguards such as the UK International Data Transfer Agreement, EU Standard Contractual Clauses, or an adequacy decision of the UK / EU authorities.

6. Retention

We keep personal data for as long as needed to provide the Service and for legitimate business, tax, and legal purposes. Account data is retained while your account is active and for a reasonable period afterwards. Billing records are retained per statutory requirements (typically 6–10 years). Your Content is deleted or anonymised on request or after account closure, subject to backup retention windows.

7. Your Rights

Depending on your location, you have the right to access, rectify, delete, restrict, port, or object to processing of your personal data, and to withdraw consent where processing is based on consent. UK / EEA users may lodge a complaint with a supervisory authority (in the UK, the Information Commissioner's Office). To exercise your rights, contact hello@klem.app. We respond within one month.

8. Cookies

We use essential cookies (authentication, session, security) that are strictly necessary for the Service. We may use limited analytics cookies to understand product usage in aggregate. You can control cookies via your browser settings; disabling essential cookies will impact the Service.

9. Security

We use appropriate technical and organisational measures — including encryption in transit, encryption at rest for stored data, access controls, and least-privilege administration — to protect personal data. No system is 100% secure; please notify us immediately at hello@klem.app if you suspect unauthorised access.

10. Children

Klem is not directed to children under 16, and we do not knowingly collect their personal data.

11. Changes

We may update this Privacy Notice from time to time. Material changes will be communicated via the Service or by email.
